LABATT TO TAKE LABEL DISPUTE TO TRIAL

Labatt Breweries of Toronto has decided to take Molson Breweries to court after a B.C. court dismissed an application for an injunction to stop Molson from selling its Carling Original Draft in cans. Labatt applied for the injunction in September. It argues that the packaging of Molson's Carling Original Draft is very similar to its Labatt Genuine Draft. Justice David Vickers said he was satisfied that consumers are not confused by labeling on the rival brands of beer. "In his view, the similarity consists of design elements common to the beer industry and not unique to Labatt," Molson says in a release. Labatt is a unit of Interbrew SA of Belgium. Molson is owned 40% by Molson Cos. Ltd. of Toronto, 40% by Foster's Brewing Group of Australia and 20% by U.S.-based Miller Brewing Co.
