ROGERS FIGHTS BACK

Toronto-based Rogers Cantel is seeking leave to appeal a court decision that granted market competitor BC Tel Mobility an injunction to stop Cantel ads claiming its service is better than BC Tel's. B.C. Supreme Court Justice Marion Allan granted the injunction last Tuesday on the "balance of convenience." This means that BC Tel would be hurt more by the ads than Cantel would be by pulling them. BC Tel launched the legal action after Cantel started its campaign on Sept. 8, citing an independent study by Lapp-Hancock Associates of Ottawa. The study found the quality of Cantel calls are good or excellent 64% of the time, compared to 11% for BC Tel. The latter countered with its own study that found its service had a stronger signal than Cantel's 58% of the time. BC Tel also said that the methodology used in Cantel's study was flawed.
