Supreme Court allows restaurants to register Barbie’s logo

The Supreme Court of Canada has confirmed the right of Quebec restaurant chain Barbie’s to register a logo incorporating the expression “Barbie’s.” Toy company Mattel had opposed the registration of such a logo due to potential confusion with its Barbie line of dolls. The court ruled that, while such confusion can occur between trademarks even when the products involved are dissimilar, the evidence did not allow this conclusion to be drawn in this case.
