Government suspends anti-spam lawsuit provision

The Government of Canada has suspended the implementation of a lawsuit provision in Canada's anti-spam legislation. The provision, which was due to come into force on July 1, would have allowed lawsuits to be filed against individuals and organizations for violations of the anti-spam law. According to the government, concerns from Canadian business, charities and non-profit groups about the cost of complying with this provision lead to its suspension. The government will instead ask for a parliamentary committee to review the legislation.

"Canadians deserve to be protected from spam and other electronic threats so that they can have confidence in digital technology," said Navdeep Bains, Minister of Innovation, Science and Economic Development. "At the same time, businesses, charities and other non-profit groups should have reasonable ways to communicate electronically with Canadians. We have listened to the concerns of stakeholders and are committed to striking the right balance."
