MICROCELL FILES SUIT AGAINST TELUS, BELL AND ROGERS

Montreal-based Microcell Solutions has filed a suit against Telus Communications, Bell Mobility and Rogers Communications alleging trademark infringement and inappropriate marketing practices. Microcell offers cellular telephone services under the Fido brand name. Microcell is seeking an injunction against Telus, Bell and Rogers to prohibit them from "engaging in certain marketing practices, including the unauthorized use of Microcell's trademarks and brand identity." According to the company, Microcell began the legal action after attempts to resolve these issues without taking legal recourse failed. In a statement Rogers said, "We received a press release as notification of this suit before we received the suit itself. We are currently reviewing the papers and have no comment at this time." Mark Langton, media relations manager for Eastern Canada at Telus Mobility, said his company is also in the process of reviewing the suit. Officials at Bell could not be reached for comment.
